Know your obligations before you clear
Before you touch anything, the tenancy must have actually ended. A property that looks abandoned might not be, the tenant could be in hospital, away for work, or on an extended trip. If you have any doubt at all, apply to NCAT for confirmation before acting. If there’s no doubt, you can change the locks and deal with what’s been left behind.
Once the tenancy has ended, the Uncollected Goods Act 1995 sets out what you can dispose of and when:
- Rubbish and perishables: no notice required, dispose of immediately
- Items worth under $1,000: 14 days notice, then dispose of by any appropriate means
- Items worth $1,000–$20,000: 28 days written notice, then sell by public auction or private sale at fair value
- Items worth over $20,000: apply to NCAT before acting
- Personal documents: 28 days written notice regardless of value, then securely destroy or return
You can recover your actual costs for removal, storage, and disposal from the former tenant. You cannot charge an occupation fee equal to rent, and you cannot withhold belongings because they owe you money — that’s a separate matter for the tribunal.
